Kandiah & Sri’s client DNC Asiatic Holdings, a manufacturer of motorcycles bearing the Demak trade mark, has been sued by Honda for copyright infringement due to the alleged similarities of the design of DNC Asiatic Holdings’ motorcycles and Honda’s EX5 motorcycles.

The registered owner of the Al Baik trade mark Al Baik Fast Food Distribution is another client of the firm. In December 2014, El Baik, the owner of the trade mark El Baik, commenced legal proceedings against the client’s licensees for infringement and passing off, and succeeded in having Al Baik Fast Food Distribution’s trade mark cancelled. However, the latter has since filed an appeal against this decision and the matter is now pending. Well regarded Malaysian lawyer P Kandiah has retired. However the firm continues to carry his name.
