Paraguay’s Patent Office

In Paraguay, the patent system is controlled by the Ministerio de Industria y Comercio.  Patents are granted in Paraguay for inventions that are novel, inventive, and useful.  To patent inventions for products or processes involving biological material, the material must be deposited in an approved institution.

Obtaining a Patent in Paraguay

Applications for patents must be submitted to the Ministry of Industry and Commerce, where they are examined for patentability.  Patents issued after January 29, 2001, remain valid for twenty years from the application date.  Prior patents have durations of only fifteen years.  Annual fees must be paid in order to maintain the validity of a patent for its full term.  Paraguay is also a member of the Paris Convention, allowing applicants to claim priority based on another application.

Recent Developments in Paraguay’s Patent Law

As of January 1, 2003, Paraguay began allowing the patenting of pharmaceutical compositions.
